Terms of Service

Section 01

Introduction

Welcome to PrismNS ("we," "us," or "our"). By accessing or using the PrismNS managed DNS service, website, APIs, or any related software (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

                    Please read these Terms carefully. By creating an account or using any
                    part of the Service, you confirm that you have read, understood, and agree to be bound
                    by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
                

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PrismNS. We may update these Terms from time to time; continued use of the Service following notice of any changes constitutes acceptance of the updated Terms.

Section 02

Service Description

PrismNS provides managed DNS hosting infrastructure designed for dynamic, automated environments. The core capabilities of the Service include:

Managed DNS record hosting via authoritative nameservers
Automated DNS record creation, update, and deletion through lightweight TCP agents deployed on your infrastructure
Real-time hostname registration and IP address tracking for dynamic environments
DNS zone management, including A, AAAA, CNAME, MX, TXT, and other standard record types
A web-based dashboard for DNS configuration, host monitoring, and zone management
API access for programmatic integration with your infrastructure and automation pipelines
Heartbeat monitoring to detect host connectivity changes and update DNS records accordingly

The Service is provided on a subscription basis. Feature availability depends on your subscription tier. We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.

Section 03

Account Requirements

To use the Service, you must meet the following requirements:

Age: You must be at least 18 years of age, or the age of legal majority in your jurisdiction if that age is higher than 18.
Accurate Information: You must provide accurate, current, and complete registration information and keep it up to date. Impersonation or misrepresentation is prohibited.
One Account Per User: Each individual or organization may maintain one active account. Creating multiple accounts to circumvent restrictions or abuse free tier limits is prohibited.
Account Security: You are responsible for maintaining the confidentiality of your credentials. Any activity that occurs under your account is your responsibility.
Notification of Breach: You agree to notify us immediately at support@prismns.com if you suspect unauthorized access to your account.

We reserve the right to refuse registration or suspend accounts that violate these requirements or these Terms at our sole discretion.

Section 04

Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. The following activities are strictly prohibited:

DNS Amplification Attacks: Using DNS infrastructure provided by PrismNS as a vector for DDoS amplification, reflection, or any other form of network abuse.
Malicious Hosting: Pointing DNS records to infrastructure used for malware distribution, command-and-control servers, phishing, ransomware, or any other malicious activity.
Spam Infrastructure: Using the Service to host DNS records for spam campaigns, bulk unsolicited email operations, or related infrastructure.
Illegal Content: Associating DNS records with content or services that are illegal in the jurisdiction where the content is hosted or accessed.
Resource Abuse: Generating excessive API requests, automated scraping, or any activity that disproportionately burdens our infrastructure relative to legitimate use.
Service Interference: Attempting to probe, scan, or test the vulnerability of the Service, or circumventing any security or authentication measures.
Reverse Engineering: Attempting to decompile, disassemble, or reverse engineer any component of the Service software.
Resale Without Authorization: Reselling, sublicensing, or providing access to the Service to third parties without our prior written consent.

                    Violation of this Acceptable Use Policy may result in immediate account suspension or
                    termination without notice and may be reported to relevant law enforcement authorities.
                

Section 05

Service Availability

We strive to provide a reliable, high-availability DNS service, but we cannot guarantee uninterrupted access at all times.

Best-Effort Uptime: We target high availability for DNS resolution services, but do not provide a formal Service Level Agreement (SLA) unless explicitly stated in a separate written agreement.
Scheduled Maintenance: We may perform scheduled maintenance that temporarily affects the Service. We will endeavor to provide advance notice via email or our status page.
Unplanned Outages: Infrastructure failures, upstream network issues, or other unforeseen events may cause unplanned service interruptions. We will communicate status and resolutions as promptly as possible.
No Liability for Downtime: We are not liable for any damages or losses resulting from service unavailability, whether planned or unplanned.

DNS propagation times are dependent on TTL settings and third-party resolver caching behavior, which are outside of our direct control.

Section 06

Payment & Billing

Paid plans are billed on a subscription basis. By subscribing to a paid plan, you agree to the following billing terms:

Subscription Fees: Fees are charged in advance for each billing period (monthly or annual, as selected). Prices are subject to change with 30 days' notice.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorize us to charge your payment method on file.
Cancellation: You may cancel your subscription at any time through the account dashboard. Cancellation takes effect at the end of the current billing period.
Refunds: We offer a prorated refund within the first 7 days of a new paid subscription if you are unsatisfied. Annual plan refunds may be considered on a case-by-case basis. No refunds are issued for partial billing periods after the initial 7-day window.
Failed Payments: If a payment fails, we will attempt to retry the charge. After repeated failures, your account may be downgraded to the free tier or suspended until payment is resolved.
Taxes: You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities. Where required by law, we may collect and remit applicable taxes.

Section 07

Data & Privacy

Your privacy is important to us. Our full Privacy Policy governs how we collect, use, store, and protect your personal information.

Data We Collect: We collect account information (email, username), DNS configuration data, host metadata (IP addresses, hostnames), usage logs, and billing information.
Data Use: Your data is used solely to provide and improve the Service. We do not sell your personal data to third parties.
Agent Telemetry: TCP agents you deploy transmit host metadata (hostname, IP address, heartbeat status) to our servers to enable DNS automation. This data is associated with your account.
Data Retention: DNS records and host data are retained for the duration of your account. Upon account deletion, we will remove your personal data within 30 days, subject to legal retention obligations.
Security: We implement industry-standard security measures including encryption in transit (TLS) and at rest. However, no system is completely secure, and we cannot guarantee absolute security.

By using the Service, you consent to data processing as described in our Privacy Policy.

Section 08

Intellectual Property

The Service, including its software, interface, design, documentation, and all associated intellectual property, is owned by or licensed to PrismNS and is protected by applicable copyright, trademark, and other intellectual property laws.

License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal or internal business purposes in accordance with these Terms.
Your Content: You retain ownership of DNS records, zone data, and configurations you create. You grant us a limited license to store and process this data to provide the Service.
Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract source code.
Feedback: If you provide feedback or suggestions, you grant us a royalty-free, worldwide license to use that feedback to improve the Service without obligation to you.

Section 09

Disclaimers & Limitation of Liability

                    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND,
                    EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY,
                    FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
                

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.

To the maximum extent permitted by applicable law, PrismNS and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

Your use of or inability to use the Service
Any unauthorized access to or alteration of your data or transmissions
DNS propagation delays or resolution failures beyond our infrastructure
Any third-party conduct or content accessible through the Service
Any other matter relating to the Service

In no event shall our total aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $50, whichever is greater.

Section 10

Termination

Either party may terminate the relationship governed by these Terms at any time:

By You: You may close your account at any time through the account settings. DNS records associated with your account will be removed within 30 days of account closure.
By Us: We may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in activity that poses a risk to the Service or other users, or fail to pay applicable fees.
Effect of Termination: Upon termination, your right to use the Service ceases immediately. We have no obligation to retain your data after termination, except where required by law.
Survival: Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive any termination of these Terms.

Section 11

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

Sending an email to the address associated with your account
Posting a notice on the Service dashboard
Updating the "Last updated" date at the top of this page

Changes become effective 14 days after notification for material changes, or immediately for changes required by law or to address security issues. Your continued use of the Service after that period constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service before the effective date.
